OFFICIAL RULES for Get It Now Forbes.com Wireless Sweepstakes No Purchase or Use of Wireless Service Necessary To Enter or Win.Wireless Service Not Required For Entry.Use Of Wireless Service Will Not Increase Your Odds Of Winning. Eligibility: Open to legal residents of the United States, 18 years of age or older as of November 5, 2002. Employees, and members of their families and/or those living in the same household of each of Verizon Wireless, Forbes.com and SmartServ Online, Inc. (together, the "Sponsors"), and each of their respective parent companies, subsidiaries, affiliates, and their advertising, promotion and production agencies, are not eligible to enter or win. How to Enter: The Get It Now Forbes.com Wireless Sweepstakes ("Sweepstakes") begins at 12:00:01 AM Eastern Daylight Time (EDT) on November 5, 2002 and ends at 12:01 AM EDT on December 30, 2002 (the "Sweepstakes Period"). A. To enter automatically by downloading Forbes.com via the Get It Now application (demonstration or subscription) from Verizon Wireless with a Get It Now capable phone (airtime charges apply), you may register to participate during the Sweepstakes Period by: 1. downloading the Forbes.com content demonstration to your handset, or 2. purchasing the Forbes.com application from your handset (subject to applicable fees). All terms and conditions must be met to participate in the Sweepstakes. Limit one registration per Mobile Telephone Number (MTN) during the entire Sweepstakes Period. Additional registrations received from any one MTN thereafter during will be void; or B. To enter without using Get It Now and incurring airtime charges related thereto, submit a postcard with your name, address and daytime area code and phone number to: Get It Now Forbes.com Wireless Sweepstakes, SmartServ Online, Inc., One Station Place, 5N, Stamford, CT 06902. Limit one postcard entry per person during the Sweepstakes Period. Additional postcard entries received from any person will be void. Postcard entries must be postmarked no later than December 30, 2002. The use of any device that automates the entry process is prohibited. Limit one registration per individual, whether via Mobile Telephone Number (MTN) or postcard entry, during the entire Sweepstakes Period. Sponsors are not responsible for lost, late, incomplete, illegible, mutilated, misdirected or postage due entries, interrupted or unavailable network, server or other connections, miscommunications, failed phone or computer hardware, software, telephone transmissions or technical failures, garbled transmissions or other errors of any kind, whether human, mechanical or electronic. No copies, facsimiles or mechanical reproductions will be accepted. If for any reason, in the opinion of any of the Sponsors, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Sweepstakes, or if technical difficulties, including but not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the control of any of the Sponsors, compromises the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, the Sponsors reserve the right, at their sole discretion, to cancel, terminate, modify and/or suspend the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted at testman.verizonwireless.com. Random Drawing: Prize winners will be selected in a random drawing on or about January 13, 2003 from among all eligible entries received by January 6, 2003. The decisions of the Sponsors will be final and binding in all matters relating to this Sweepstakes. Winners will be notified by telephone and/or regular mail. The odds of winning will depend on the total number of eligible entries received. Prizes will be awarded to the person named on applicable registration form, regardless of whether that is the name of the MTN account holder from which said entry was submitted (if submitted via a Get It Now capable phone). Limit one prize per person, MTN, family or household. No prize or cash substitutes, substitution, transfer or assignment of prizes permitted, except a prize of equal or greater value may be substituted at the Sponsors' discretion due to prize unavailability. Federal, state and local taxes and all other expenses not specified herein are winners' sole responsibility. Prizes: Grand Prizes: Two (2) Hewlett Packard (HP) laptop computers (Approximate Retail Value (ARV) = $2,000.00 each) (2 individual prizes to be awarded). First Prize: One (1) HP 15 inch flat panel display (ARV = $650.00). Second Prizes: Five (5) Compaq IPAQs (ARV = $650 each) (5 individual prizes to be awarded). Third Prizes: Three (3) HP PhotoSmart Printers (ARV = $450.00 each); one (1) HP Digital Camera (ARV = $550); and five (5) Motorola 720 Color Digital Phones (Handset only; prize excludes activation or service; AVR = $369 each) (9 individual prizes to be awarded). Total AVR for Sweepstakes = $11,792. General Conditions: Sweepstakes governed by U.S. law. Prize winners must claim his/her prize within fourteen (14) days after prize notification. Winners may be required to sign and return a Declaration of Eligibility, Publicity Consent and Liability Release within fourteen (14) days of notification. If a selected winner cannot be contacted by telephone, prize notification letter is returned as undeliverable, is ineligible, fails to claim a prize or fails to return any Declaration of Eligibility, Publicity Consent and/or liability Release, the selected winner will be disqualified and an alternate winner may be selected. By registering and participating, entrants agree to be bound by these Official Rules and agree that: 1. the Sponsors, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, and advertising/promotion agencies may use (unless prohibited by law) their name, voice, city/state of residence, photograph, visual and/or audio likeness for advertising and/or trade purposes and for any other purpose in any media or format now or hereafter known without further compensation, permission or notification; and 2. the Sponsors, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, employees, representatives and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any element of prize or prize activities related thereto or participation in this Sweepstakes. Winners of the Motorola 720 Color Digital Phones are responsible for activation of service, signing an annual Customer Agreement and all applicable fees.
