Mobile Web Terms & Conditions

Accessing or using the Mobile Web* service, including the browser, email, chat rooms, message boards and other community services is the equivalent of your agreement to these terms and conditions. Mobile Web requires a data-capable phone with specific software and Web browser. Web browser does not provide full Internet access. Sites may be text only or formatted to optimize phone's screen size. Not all services or sites are compatible with Mobile Web supported handheld devices. Content providers, service and functionality and menu order may change without notice. A billable setup data call is required to initiate service and enable security for Web browser activation and ESN changes. Call may take up to five minutes, depending on the phone. Any interruption of this call (by pressing "END," powering off or call drops) will necessitate an additional billable setup call. Upon subscribing to the Mobile Web service you will be billed a subscription charge each month until you cancel your subscription. Whenever you launch the browser on your device you are charged airtime use fees according to your Calling and/or Data Plan, unless otherwise specified. You are responsible for ensuring that your browser session is ended and disconnected from the network upon completion of use. Charges will cease when you press "END"on your wireless device and when your browser disconnects from the Verizon Wireless network.

You agree that while using the service, you will not violate any applicable law, regulation, code or rule, or post or transmit any commercial, advertising or promotional materials, including, without limitation, "spam" or mass distributions.

Consent to Monitoring and Disclosure. You agree that we may monitor emails, communications, postings, data or information periodically, in order to comply with any applicable laws, regulations or other governmental orders, and/or to operate the services properly, or to protect ourselves and you. We reserve the right to delete, reject or eliminate, in whole or in part, any information available or transmitted through Mobile Web that we, in our sole discretion, believe is unacceptable or in violation of these terms and conditions. You agree that we are not responsible or liable for deactivation or deletion of accounts or for loss of emails, communications, postings, data or information which may occur as a result of or arising out of the administration of the Mobile Web service.

Premium Content Services. Should you decide to subscribe to a premium content service (only available if you subscribe to the Mobile Web 2.0 service - i.e., premium Mobile Web 2.0 services are not available to customers who access Mobile Web 2.0 on a per-use basis - the per-use basis option is not currently available but is slated to be available later this year). You understand and agree that your premium subscription fee shall be included in your Verizon Wireless bill. Service (also known as LBS APPLICATIONS) or (iii) protect you or other customers. In the event you provide Verizon Wireless, or its affiliates, contractors or agents, with feedback, data, answers, questions, comments, suggestions, plans, ideas or other information, such information will be deemed to be nonconfidential and Verizon Wireless will be free to reproduce, disclose, distribute or use such information without restriction. When downloading applications, including content such as games, Ringtones and wallpaper, those applications can only be used on the device to which they were downloaded, even if downloaded pursuant to an unlimited or other long-term agreement. No transfers, credits or refunds are permitted. Taxes, other charges and restrictions apply. On some phone models, if you add an Unlimited or Megabyte data feature to your Calling Plan, your monthly data allowance and overage rates will apply when you use the Web browser, and when you shop for, download and use downloadable applications. The service, as well as the download, installation and/or use of the applications, will be governed by and construed in accordance with the laws of the State of New York, excluding its conflict of law provisions. The jurisdiction and venue described in your Customer Agreement will apply.

GET IT NOW® License Agreement

Carefully read the terms and conditions set forth in this Get It Now License Agreement ("LICENSE AGREEMENT") before downloading, installing or using any Ringtones, games, productivity tools or other Get It Now applications ("APPLICATIONS") to your wireless communications device. To the extent that you download, install and/or use any of the APPLICATIONS, you agree to be bound by all the terms and conditions set forth in this LICENSE AGREEMENT.

Agreement. This LICENSE AGREEMENT is between you and each of the developers of the APPLICATIONS ("DEVELOPERS"), individually, for each APPLICATION. Although Verizon Wireless has been licensed by the DEVELOPERS to sublicense each APPLICATION to you, Verizon Wireless is not a party to this LICENSE AGREEMENT.

Limited License. The DEVELOPERS, through Verizon Wireless, grant to you a nonexclusive, limited license to download, install and/or use the object code version of the APPLICATIONS on your wireless communications device. All rights not expressly granted in this LICENSE AGREEMENT are reserved by the DEVELOPERS.

Other Software. Notwithstanding any other provision of this LICENSE AGREEMENT, this LICENSE AGREEMENT shall not be deemed to apply to any software that is licensed to you by third parties and that is included on your wireless communications device ("OTHER SOFTWARE"). Any such OTHER SOFTWARE is subject to the terms and conditions of the license agreement, if any, between you and the developer or licensor of the OTHER SOFTWARE.

Restrictions. No license is granted to you by this LICENSE AGREEMENT in the human readable code, known as the source code, of the APPLICATIONS, and no rights are granted to you by this LICENSE AGREEMENT in any patents, copyrights, trade secrets, trademarks or any other rights in respect of the APPLICATIONS. In addition, no license is granted to you by this LICENSE AGREEMENT to decompile, reverse-engineer, disassemble or modify the APPLICATIONS. Further, no license is granted to you by this LICENSE AGREEMENT to: (i) remove, efface or obscure any copyright or other proprietary notices from the APPLICATIONS; or (ii) exploit, copy, reproduce, sublicense, transfer or assign the APPLICATIONS.

Ownership. You agree that the DEVELOPERS retain all right, title and interest in and to the APPLICATIONS and all copies of the APPLICATIONS. This includes all copyrights in the APPLICATIONS.

Term and Termination. This LICENSE AGREEMENT will become effective with respect to each APPLICATION on the date you first download, install and/or use such APPLICATION, and it will remain in effect until terminated. You may terminate this LICENSE AGREEMENT with respect to any APPLICATION at any time by removing such APPLICATION from your wireless communications device. This LICENSE AGREEMENT will also terminate immediately with respect to all APPLICATIONS, without notice, if you fail to comply with any term or condition of this LICENSE AGREEMENT. Upon such termination, you agree to immediately remove all APPLICATIONS from your wireless communications device.

YOU ASSUME ALL RESPONSIBILITY AND RISK FOR THE USE OF THE SERVICE AND THE INTERNET GENERALLY. THE USE OF THE INFORMATION, PRODUCTS, AND/OR SERVICES PROVIDED ON OR AVAILABLE THROUGH THE SERVICE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. NEITHER VERIZON WIRELESS NOR ITS AFFILIATES WARRANT THAT THE INFORMATION, PRODUCTS, PROCESSES, AND/OR SERVICES AVAILABLE THROUGH THE SERVICE WILL BE UN-INTERRUPTIBLE, ACCURATE, COMPLETE, USEFUL, FUNCTIONAL OR ERROR FREE, OR THAT ANY INFORMATION, SOFTWARE OR OTHER MATERIAL ACCESSIBLE THROUGH THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE HAVE NO CONTROL OVER OR RESPONSIBILITY FOR CONTENT ON THIRD-PARTY WEBSITES. WE CANNOT BE HELD LIABLE FOR ANY DAMAGES OR INJURY ARISING FROM CONTENT ON SUCH THIRD-PARTY WEBSITES. We cannot guarantee your confidential or secure use of the Service. We shall not be responsible for any harm that you or any person may suffer as a result of a breach of confidentiality or security in respect to your use of the Service.

*Due to recent internet privacy and security enhancements, you won’t be able to access secure page (HTTPS) sites with Mobile Web.
